CONFIDENTIALITY POLICY

 

ARTICLE 1 – PREAMBLE

 

The respect of VISITORS' private lives and personal data is a priority for LEGENDE EVENTS, which is committed to complying with the French Data Protection Act n° 78-17 of January 6, 1978 as modified by Act n° 2004-801 of August 6, 2004 (hereinafter referred to as "Data Protection").


This Confidentiality Policy concerning personal data is aimed at informing VISITORS to the BOUTIQUE which can be accessed at the URL address www.brigitte-bardot.fr of the manner in which their PERSONAL DATA can, if necessary, be collected and processed by LEGENDE EVENTS.


The purpose of this Confidentiality Policy is to explain how LEGENDE EVENTS collects, protects and uses VISITORS' personal data in the framework of their browsing and use of the services of the BOUTIQUE.


Any use of the BOUTIQUE regardless of the reason, necessarily implies that VISITORS and CUSTOMERS have read this Confidentiality Policy.

 

ARTICLE 2 – DEFINITIONS

 

BOUTIQUE: refers to all the pages of the website that are accessible from the URL www.brigitte-bardot.fr


CUSTOMER: refers to the LEGENDE EVENTS' contracting party who guarantees having the capacity of a consumer as defined by French law and jurisprudence.


PERSONAL DATA: Any personal data as defined in article 2 of the Data Protection act, i.e., any information concerning an identified natural person or one who can be identified, directly or indirectly, by reference to an identification number or to one or more elements belonging to him/her. To determine whether a person is identifiable, all the means available to the person responsible for the processing or any other person should be considered, to enable his/her identification.


VISITOR: refers to any internet user who accesses and browses in the BOUTIQUE, including CUSTOMERS.

 

 

ARTICLE 3 – WHO PROCESSES PERSONAL DATA?

 

PERSONAL DATA is collected by LEGENDE EVENTS (above and hereafter referred to as "LEGENDE EVENTS"), located at 8 rue d'Alexandrie, 75002 PARIS, a limited liability company with share capital of 640 000 euros, registered at the Paris ROC under the number 53538597500011.

 

ARTICLE 4 – DATA PROCESSING IS TRANSMITTED TO THE CNIL

 

Data collected via the BOUTIQUE is subject to personal data processing which is declared to the French Data Protection Authority (CNIL), under the number h9w047218m.

 

ARTICLE 5 – HOW IS DATA PROCESSED?

LEGENDE EVENTS collects PERSONAL DATA on the BOUTIQUE.


The data is notably collected via browsing the BOUTIQUE (example: IP address) or via the BOUTIQUE contact forms such as the form to create an account, for subscription to the Newsletter or to place an order. This data is essential for processing CUSTOMER orders.


In particular, LEGENDE EVENTS might collect, store or use the following data: login name, surname, first name, address, post code, town of residence, e-mail address, order history, wish list, total amount per order, and IP address. Without collecting this data, VISITORS AND CUSTOMERS' orders cannot be finalised.

 

ARTICLE 6 – WHAT IS THE PURPOSE OF THIS DATA?

This data is processed in conformance with the intended purpose of collection.


For example: LEGENDE EVENTS collects personal data required for VISITORS to enrol on the WEBSITE, for the management of CUSTOMERS' accounts, for placing orders or for statistical measurements aimed at improving the functioning of the BOUTIQUE. LEGENDE EVENTS might also use this data for legal and/or regulatory purposes.


In any event, LEGENDE EVENTS is committed to processing all data collected in conformance with the Data Protection Act.

 

ARTICLE 7 –DATA IS TRANSMITTED TO WHOM?

 

This data is processed by the competent departments of LEGENDE EVENTS, the LEGENDE EVENTS Group companies and the BOUTIQUE host. The LEGENDE EVENTS Group companies are companies that are legally attached to LEGENDE EVENTS such as the LEGENDE EVENTS companies;


Data is by no means transmitted to third parties and no PERSONAL DATA is transmitted outside of the European Union.


LEGENDE EVENTS also reserves the right to transmit PERSONAL DATA in order to meet its legal obligations, and notably if it is forced by legal requisition.

 

ARTICLE 8 – VISITOR AND CUSTOMER RIGHTS

 

It should be borne in mind that the person whose PERSONAL DATA is processed, benefits from the right to access, rectify, delete and contest, for legitimate reasons, the processing of personal data, in conformance with article 38 et sequens of the Data Protection Act.


This right can be exercised, in conformance with the Data Protection Act by simple request by electronic mail to the address contact@brigitte-bardot.fr and by specifying "Data Protection" in the message subject and attaching a copy of your identification card.


In addition, LEGENDE EVENTS is committed to keeping collected data in a form that enables the identification of the persons concerned, for a period that does not exceed the period required for the purposes for which they are collected and processed.

 

ARTICLE 9 – PROTECTION OF MINORS

 

The protection of children is fundamental for LEGENDE EVENTS and parents' responsibility is of particular importance in this domain.


For this reason, LEGENDE EVENTS does not knowingly solicit the PERSONAL DATA of minors because only adults over 18 years of age or minors with proof of authorisation from their legal representatives are authorised to buy from the BOUTIQUE.

 

ARTICLE 10 – FACEBOOK

 

All VISITORS can click on the button "I love" that appears on the BOUTIQUE.


For this reason, the information that VISITORS indicate as public and accessible on their FACEBOOK profile is accessible to LEGENDE EVENTS.


However, LEGENDE EVENTS neither creates nor uses any data base independent of FACEBOOK, from the information that the VISITOR might publish there.


If the VISITOR does not want LEGENDE EVENTS to have access to the information published on his/her profile and which are visible to the public, the VISITOR should simply configure his/her FACEBOOK account to that effect;

ARTICLE 11 – BUSINESS PROSPECTION

 

LEGENDE EVENTS enables VISITORS to enrol in order to benefit from a newsletter which informs them of new products and promotional offers.


In order to receive the newsletter, the VISITOR is asked to give his/her consent by ticking off the box "I would like to receive the Newsletter".


In any event, the VISITOR can inform LEGENDE EVENTS that he/she no longer wishes to receive the newsletter by clicking on the hypertext link for this purpose at the bottom of each newsletter or by contacting the customer service by e-mail at: contact@brigitte-bardot.fr and by specifying "STOP-Newsletter" in the e-mail subject.

 

ARTICLE 12 – POLICY CONCERNING COOKIES

When the BOUTIQUE is visited, a cookie might be automatically installed on the VISITOR'S browser software. The cookie enables the internet user to browse the BOUTIQUE.

Access to information stored on the terminal equipment or registration of information on the VISITOR'S or CUSTOMER'S terminal equipment will then be enabled:

- with the exclusive purpose of enabling or facilitating electronic communication;

- strictly required for providing the LEGENDE EVENTS on-line communication service by the internet user's express request;

- to measure the BOUTIQUE audience.

If the VISITOR'S or CUSTOMER'S internet browser so allows, they can deactivate these cookies at any moment by following the procedure indicated by this browser.

Configuration of the browser software enables indicating the presence of cookies and to refuse them. However, LEGENDE EVENTS informs VISITORS and CUSTOMERS that such deactivation will result in preventing them from accessing certain services and/or functionalities of the BOUTIQUE.

LEGENDE EVENTS also installs cookies for marketing purposes that can be removed at any moment by clicking here.

ARTICLE 13 – DELETION OF PERSONAL DATA

 

The CUSTOMER can ask for his/her BOUTIQUE account to be cancelled.

The cancellation of this account results in the deletion of data related to this account within a period of 30 days as of receipt of the request for cancellation of the account.

In addition, a CUSTOMER account can be cancelled if after 24 months there is no connection to the account.

 

ARTICLE 14 – SAFETY MEASURES

 

For LEGENDE EVENTS, VISITORS' and CUSTOMER' data confidentiality and security are very important issues.

 LEGENDE EVENTS is committed to taking all useful precautions against risks presented by processing, to preserve data safety and notably, prevent their distortion, damage or unauthorised access by third parties. They are particularly committed to complying with all the technical specifications with which processing is required to comply.

LEGENDE EVENTS shall cooperate with the competent authorities in case of an investigation for violation of the General conditions of use of the BOUTIQUE or the General conditions of sale of articles available on the BOUTIQUE, or in general, any violation that could compromise the safety of the BOUTIQUE or the data processed there.

 

ARTICLE 15 – UPDATING

 

LEGENDE EVENTS agrees to be in conformance with the requirements concerning the protection of individuals' private lives. For this reason, LEGENDE EVENTS shall update this Confidentiality Policy, if necessary.
