Any order placed on the website www.brigitte-bardot.fr shall be governed by these General Conditions of Sale (GCS).
These GCS have been finalised between Legende Events and the CUSTOMER, a non-professional purchaser of consumer articles intended for his personal use.
The CUSTOMER and LEGENDE EVENTS shall be referred to as the PARTIES in these general conditions of sale.
Any resale of articles bought on this Website is strictly forbidden. For this reason, each order is limited to a maximum total of 30 (thirty) articles.
Orders will only be validated after acceptance of payment.
LEGENDE EVENTS is committed to honouring orders received within the limit of available stocks and in the event of unavailability, to inform the Customer by any possible means. The Customer may then cancel his order and be reimbursed the amounts already paid, if necessary. LEGENDE EVENTS reserves the right to cancel or refuse any order from a Customer with whom there is an existing litigation concerning the payment of a prior order.
Acknowledgement of receipt of the order:
When the payment has been made, a summary document of the order is sent by LEGENDE EVENTS to the Customer, by electronic mail to the electronic address indicated by him, immediately, and at the latest, before delivery.
This document, which represents an acknowledgement of receipt of the Customer's order, includes all the elements that constitute the contract between the parties.
The purchase order is registered in the LEGENDE EVENTS registers which are stored on a reliable and durable medium. The customer agrees for the purchase order to be considered as proof of the contractual relations between the parties.
The customer will be able to print the summary purchase order sent with the acknowledgement of receipt. The order summary shall also be accessible on the Website on the "My account" page.

Delivery methods :
LEGENDE EVENTS delivers its products in Metropolitan France, including Corsica as well as Europe. Articles will be dispatched to the delivery address indicated by the Customer at the time of the order (excluding Post Boxes).
In the event of an error in the wording of the Customer's address, LEGENDE EVENTS cannot be held responsible if it is impossible to deliver the article(s) ordered.
Delivery date :
LEGENDE EVENTS is committed to delivering to the Customer within the deadline indicated before validation of the order and on condition of payment. In the event of a late delivery of more than 7 working days, if the article has not been dispatched, the Customer can cancel the order by registered letter with acknowledgement of receipt and request reimbursement for his order.
If the article was dispatched before receipt of the cancellation of the order due to late delivery of more than 7 days, LEGENDE EVENTS shall proceed with the reimbursement of the article on its receipt, returned whole, in its original condition and with all the labels.
LEGENDE EVENTS agrees to inform the Customer of the progress of the processing of his order.
LEGENDE EVENTS cannot be held responsible for late deliveries due to the occurrence of circumstances beyond their control or strikes.
Each delivery is considered made upon the distribution of the Box to the Member or the recipient of the Subscription, especially by the carrier, materialised by the control system that is used by the carrier, such as the track and trace system proposed on the website of La Post about « So Colissimo ».
It is up to the Member or the recipient of the Subscription to verify the condition of the parcel (or package) as well as its contents at the time of receiving the delivery and to have reservations and make a complaint which would seem justified, even to refuse the parcel/package, if it is likely have been opened or it shows the obvious signs of deterioration. The aforementioned reservations and complaints must be sent to the carrier by registered letter with the recorded delivery within three working days following the delivery of the Box, a copy must be immediately sent to www.brigitte-bardot.fr

The prices that are indicated are expressed in euros and include taxes, excluding carriage costs which are the Customer's responsibility. Any legal change in the rate of the applicable VAT shall be automatically reflected in the prices of the articles as soon as it becomes effective.
Complete payment must be made at the time of the order. Amounts paid cannot, at any moment, be considered as deposits or down payments. The Customer pays for his order by bank card (Visa, Eurocard/Mastercard, Blue Card and Paypal) in conformance with the provisions of this article.
For all transactions, the Customer shall indicate the number on the front of his card, the expiry date and the cryptogram on the back of the card (the last three numbers).
The Customer's transmission of his bank card number confirms his authorisation for LEGENDE EVENTS to debit his account of the due amount of his order.
No cash on delivery will be accepted under any circumstances.
LEGENDE EVENTS preserves the ownership of the article until the Customer has made complete payment of the price. Purchases are made in a secured manner. The payment methods adopted by LEGENDE EVENTS are 100% secured. For payments by bank card (Blue Card, Visa and Mastercard), CIC payment takes responsibility for securing payments. All information that Customers transmit to LEGENDE EVENTS are strictly protected and LEGEND EVENTS ensures the conformance and securing of each transaction.
The basic characteristics of the articles are presented at www.brigitte-bardot.fr in each of the product data sheets. The Customer is fully informed that the images, pictures and colours of articles that are available for sale might not correspond to the real colours due to the effect of the Web browser and the screen used.
If the Customer is not satisfied, he has a deadline of fifteen days as of the dispatch date to return the article and obtain reimbursement of the amounts already paid. This deadline includes the legal deadline of seven days according to articles L121-20 et sequens of the Consumer Code.
The article must be returned new, in its original package accompanied by a return slip or the invoice, to the following address: CARLING 8 rue d'Alexandrie. 75002 PARIS
In the absence of a return slip, LEGENDE EVENTS cannot proceed with the reimbursement of the returned articles.
Articles that are returned incomplete, damaged, worn or soiled shall not be accepted.
The Customer shall be reimbursed for the returned article within a maximum of thirty days as of receipt by LEGENDE EVENTS. It is the Customer's responsibility to keep all proof of return, i.e. return by registered mail or any other means that confirms the date of his shipment.
The reimbursement shall be made by credit of the amount to be reimbursed to the Customer's bank account that was debited at the time of the transaction (excluding the carriage costs).
The legal right to cancel and the "satisfied or reimbursed" guarantee do not apply to articles made according to the Customer's specific requirements or articles that are clearly personalised.
Articles are returned at the Customer's risk and expense.
For all exchanges, the Customer should contact the Customer Service Department which will inform him of the procedure to be followed by e-mail at the following address: email@example.com
In any event, no article purchased on the Website can be exchanged or returned in shops or stands.
LEGENDE EVENTS is responsible for defects in the conformance of products available for order and for hidden defects under the conditions provided in articles 1641 and 1649 of the Civil Code. In conformance with the provisions of order n° 2005-136 of February 17, 2005, the previously cited articles of the Civil Code as well as the articles of the Consumer Code concerning the guarantee of consumer goods are laid out in these GCS
The personal data collected on the Website www.brigitte-bardot.fr, are required for processing orders and in general, for managing LEGENDE EVENTS's business relations with its Customers and are intended for LEGENDE EVENTS and its external partners.
In order to make purchases on the Website, the Customer must create an account and choose an e-mail address and a password which will be required each time he wishes to have access. The Customer's personal information is therefore protected by a password so that only the Customer will have access to it. LEGENDE EVENTS recommends that the Customer does not transmit it to anyone. In addition, the Customer should log out from his profile and close his navigator window at the end of each session, especially if the Customer uses computer equipment shared by others. The Customer will thereby prevent users from accessing his personal information. The Customer is solely responsible for the confidentiality of his password. The Customer shall be the sole bearer of the consequences of fraudulent use of his password.
In conformance with the law of January 6, 1978, the Customer has the right to access his personal data, which he can exercise by writing to the Customer Relations Department without prejudice to his right to contest the previously cited conditions of use of his personal data for commercial solicitations by LEGENDE EVENTS alone or in partnership with other companies and/or directly by third parties, transferee companies of the said personal data.
Applicable law and jurisdiction
These GCS are subject to French law. In case of litigation, exclusive jurisdiction is attributed to the competent French courts, notwithstanding the plurality of defendants and/or introduction of third parties even in emergency procedures or provisional proceedings or proceedings by request.

The seller is responsible for delivering the goods in conformance with the contract and for defects in conformance at the time of delivery. He is also responsible for defects in conformance resulting from the packaging, assembly or installation instructions when he was given this responsibility through the contract or if this was completed under his responsibility.
In order to be in conformance with the contract, the goods should: 1º Be specifically for the use that is usually expected of such goods and, if necessary: - correspond to the description provided by the seller and have the qualities he presented to the buyer in the form of a sample or example; - have the qualities that a buyer can legitimately expect in light of the public statements made by the seller, the producer or his representative, notably in the advertising or labelling; 2º Or present the characteristics defined by common agreement by the parties or be appropriate for any special use desired by the buyer, brought to the seller's attention and accepted by him.
Lawsuits for defects in conformance must be filed within two years as of delivery of the goods.

The seller is responsible for guaranteeing against hidden defects in the thing sold that make it inadequate for the intended use, or decrease this use to the stage where, had the buyer been aware, he would not have bought it, or would only have bought it at a lower price.
Lawsuits for latent defects should be filed by the buyer within two years as of the discovery of the defect.
